GENERAL CONDITIONS OF CONTRACT – SANTILLAN RETREAT S.L.
1. DEFINITIONS
Santillán: Santillan shall mean, all the hotel facilities, both building used for accommodation and catering, as well as any other building, facility or place within the estate where the hotel is located.
The Client: The Client shall be understood to be the natural or legal person who makes a reservation at The Hotel for a specific period of time.
Users: Users shall be understood to be any person who comes to the hotel through or as consequence of the booking made by the Client, whether they are teachers, assistants to teachers, students or any other person attending the event for any reason whatsoever.
Activity or Event: It is carried out bu the Cleint who organises, designs and delivers the activities.
Guest: Participant who have contracted with the Cleint to carry out the activity.
2. EXCLUSIVITY IN THE USE OF THE FACILITIES
During the period when Santillan is booked by the Client, SAntillan will refrain from making any other retreat, so that The Cleint and The Users will enjoy the facilities as an exclusive retreat.
3. MINIMUM NUMBER OF PARTICIPANTS
The minimum number of participants required to make a reservation is:
- 16 students from November to April
- 20 students from May to October
regardless of the teaching staff.
4. SERVICES INCLUDED IN THE PRICE AND SPECIAL CONDITIONS
The price paid for the use of Santillan will include:
- Use of the Santillan facilities, except for those that are closed to the public and accesible only to Santillan´s staff.
- Accommodation, including one free place for the main teacher and a 50% discount for the second teacher or assistant.
- Use of a yoga space and the props avialable for the practice of this activity.
- Meals, you can choose at the time of confirming the reservation between:
- Breakfast, Lunch and Dinner
- Tea & Fruit, Brunch and Dinner
In both cases, water, tea and coffee are included.
5. MANDATORY ACCOMMODATION
In order to guarantee the correct development of the retreats, as well as to guarantee the environmental and calm conditions in which the retreat will take place, all participants must be accommodated in Santillan, including students, teachers and staff attending the event, with the following limitations:
- Swimming pool: may only be used during the estival season, wich will be determinated at any given time by the management of Santillan, depending on the environmental conditions. Its use at any other time of the year must be expressly requested in writting, and must also be consented to in writting by the management of Santillan.
- Yoga studio: You may use the yoga spaces from 17.00 on the day of arrivals until 9.30 am on the day of departure.
6. SERVICES EXCLUDED FROM THE PRICE
The following items are excluded from the price:
- Transfers
- Treatments, such as (as an example): massages or sonotherapy
- Excursions
- Consumption of alcoholic and soft drinks
7. PAYMENTS
Deposit:
- A) A deposit of € 2.000 is required to confirm the booking. Once the event has started, the deposit will be held as a security deposit.
- B) This deposit is non-refundable in case of cancellation.
- C) After the retreat, the Client may choose:
- Transfer the deposit to a new date, if you wish to make a new reservation.
- Receive a full refund, minus any damage that may have occurred during the retreat.
Payment schedule:
Option 1:
- 3 months before the event: 50% of the total amount. In order to do so, the Client must confirm the number of people registered for the event.
- If the minimum number required is execeded, 50% of the number of attendees confirmed so far will be calculated.
- If the minimum number of participants has not yet been reached, 50% will be calculated on the basic of the minimum guests number required at the shared room rate.
- 1month beofre the event: The remaining amount. At this point, the total amount of the retreat will be calculatedon the basis of the total number of participants and type of room booked, minus the payment previously made. If the minimum number of participants is not reached, this amount will be calculated on the basis of the required minimum guests number.
Option 2:
- 6 months before the event: A second deposit of €2.000 will be required to continue with the reservation. This deposit will be governed by the same conditions as the original deposit in the event of event cancellation.
- Upon arrival, the total amount of the reservation must be paid before check in. In this case, the €2.000 paid in the second deposit will be deducted and will be considered as a down payment.
8. CHECK-IN AND CHECK-OUT
This must be done at the following times:
- Check in: from 15.00 on the day of arrival
- Check out: until 10.00 am on the day of departure
9. RESPONSABILITY
The Client, as organiser of the retreat, will be responsible for promoting the event and handling all bookings and requests. In addition, he/she will be responsible for collecting payments from customers and then paying out to Santillan the agreed amount.
Likewise, the Client shall be responsible for any incident or accident occurs during the performance of any of the activities carried out in Santillan that have not been independently contracted.
To this end, it will be necessary for each of the Users to sign a docuemnt in the check in process exonerating SAntillan from liability.
The Client will also be responsible for any damage that any of the users, teaching staff or assistants may cause during their stay at Santillanto the facilities, including any plant or animals that be found on the property where Santillan is located.
10. INSURANCE
The Client, as the person responsible for the event, must have an appropriate insurance policy in force for the activities to be carried out in Santillan that covers any incident that may occur to the teaching staff, their assistant or the users.
Each participant us also required to take out adequate travel insurance to cover activities such as yoga, event cancellations, flight and other eventualities.
11. ADVERTISING
The retreat will be included on the Santillan´s website (https://www.santillanretreat.com). To do it, the Client must send a description of the event, including the activities that will take place, the final price, contact details and how to book.
Likewise, the Client undertakes to promote the event throught her/his website, mailing list, advertisements, flyers or any social network he /she may have. To this end, the Hotel will provide images of its facilities if required, for the sole and exclusive purpose of promoting the event, and the use of such images for any purpose other than the before mentioned is estrictly prohibited.
12. CANCELLATIONS AND MODIFICATIONS
Cancellations by the Client:
a). In case of cancellations less than 6 months in advance: Cancellation charges will be 50% of the total amount of the retreat, based on the minimum number of guests required to book, at single room rate, with loss of deposit.
b). In case of cancellations less than 3 months in advance: Cancellation charges will be 100% of the total amount of the retreat, based on the minimum number of guests required to book, at single room rate, with loss of deposit.
Cancellation by Santillan
In the unlikely event that the Hotel has to cancel the booking, the amount paid for the booking, includind the deposit, will be refunded. Subsidiary costs such as airline tickets and other travel expenses are not refundable.
13. TRANSFERS
Santillan, as an additional service, can organise transfers for Users, from the airport or from Malaga to its facilities at market prices. These transfers will be carried out by local taxi drivers or VTC drivers and should be paid directly to the drivers.
To this end, the Client will have to provide the flight numbers, airport of origin, arrival time and contact telephone number of each of the Users who require the service.
Tha Client shall be responsible for collecting this information and providing it to us at least 4 days prior to arrival. It can not be guaranteed that the transfer service can be contracted if this deadline is not met.
In the case of Users with flights that are scheduled to arrive or depart within 30 minutes of each other, a shared car system will be established.
14. CATERING & DIETARY RESTRICTIONS
The Client commits to inform Santillan at least one week in advance of any dietary restrictions that any of the Users may have so that, within its possibilities, Santillan can meet any dietary requirements.
If for medical reasons, any User has severe dietary restrictions, he%she should bring with him/her whatever is essential for his/her diet and well-being. For this purpose, there is a refrigerator dedicated to the exclusive use of these Users if they need to store any food at low temperature.
If any user is prone to a severe reactions to an allergen, however small the exposure, it is essential that Santillan is informed of such a circumstance at least one week in advance. Please note that we can not offer absolute guarantees for these allergic conditions.
15. USE OF PSYCHOACTIVE PLANTS
The use of psychoactive plants such as ayahuasca, peyote, cannabis, mushrooms, and similar substances is strictly prohibited. Both natural and synthetic.
16. COURT JURISDICTION
In the event of any conflict arising between Santillan and the Client or any User, both parties commit to try to resolve said conflict on the basic of rules of good faith and peaceful coexistence, in an amicable manner.
However, if such a peaceful solution is not possible, and a judicial authority must mediate, Each of the Client and Santillan irrevocably consent to the exclusive jurisdiction and venue of the courts within the hotel´s place of residence (Velez-Málaga) or their hierarchical superiors to resolve the conflicts that arise.
